The idea
Write with Sie to a teacher or tutor unless you already say du. “Darf ich …?” is the standard way to ask permission. Konjunktiv II “würde … nicht weitergeben” makes a promise about a hypothetical recording. “Ausdrücklich” (explicitly) shows you want a real yes, not silence. Offer an alternative with “Falls nicht, …” and end with a firm commitment: “Ohne Ihre Zustimmung beginne ich keine Aufnahme.”
Other ways to say it
“Wäre es für Sie in Ordnung, wenn ich mitschneide?” – Polite; “mitschneiden” is a common word for recording audio.
“Kann ich die Erklärung mit dem Handy aufnehmen?” – Neutral and simple; names the device.

Watch out
“Darf ich die Erklärung im kommenden Lerngespräch aufzunehmen?” → “Darf ich die Erklärung im kommenden Lerngespräch aufnehmen?”: Modal verbs like dürfen take a bare infinitive without zu. The zu-form aufzunehmen is used after verbs such as versuchen or planen.
